The right to disappear
Article 4 of the Declaration of the Rights of Man of 1789
" Freedom consists in doing whatever does not harm others ."
Please note that in France, disappearing is a right. Indeed, leaving one's spouse, children and friends is a freedom that every French person has. According to the law, if an adult is not being prosecuted for a crime or offence and their disappearance is not considered worrying, this person has every right to rebuild their life and therefore to disappear .
The investigation into the search for a missing person is opened by decision of the Public Prosecutor.
In practice, the investigation takes place in two stages:
a first justified by the urgency – due to the temporal proximity of the disappearance – which will see the rules of the flagrante delicto investigation applied,
then a second in the form of a preliminary investigation.
In the first stage of the investigation, all possible investigations are used within the framework of a flagrante delicto investigation. This first stage lasts 8 days which cannot be renewed.
At the end of the 8th day, the investigation switches to the form of a preliminary investigation.
At the end of the investigation, when the person is found, the investigation into the search for a missing person ends.
If the person found is dead or injured, the Public Prosecutor decides what to do next: investigation into the crime, preliminary investigation, request to open a judicial investigation or dismissal without further action.
Conversely, at the end of the investigation when the person has not been found, the Prosecutor has several options:
if the missing person is the victim of a crime, the Prosecutor opens an investigation either in flagrante delicto or in a preliminary manner;
if the missing person is the victim of a crime, the Prosecutor requests the opening of a judicial investigation;
If the investigations have not made it possible to determine what happened to the missing person, the Prosecutor may decide either to close the case without further action or to request the opening of a judicial investigation to find the causes of the disappearance.

Furthermore, Article 1341 of the Civil Code states: "The creditor has the right to the performance of the obligation; he may compel the debtor to do so under the conditions provided for by law."

Service of a court decision for enforcement
At the end of a legal procedure, a legally enforceable court decision is issued. In order to serve this decision, the bailiff will need the actual address of the convicted person.
