Reimbursement of investigation costs
The irrecoverable costs (all costs incurred for the purposes of the procedure but which are not legally essential) of the private detective during a trial may be borne by the opposing party:
on the basis of article 700 of the Code of Civil Procedure which provides: "The judge orders the party liable for costs or who loses the case to pay: To the other party the sum he determines, for costs incurred and not included in the costs...",
on the basis of articles 475-1 or 375 of the Code of Criminal Procedure,
on the basis of article L761-1 of the Code of Administrative Justice.
This provision is not, however, systematic and remains subject to the judge's discretion; it is therefore advisable to request it.
Family Investigation / Adultery
Article 242 of the Civil Code states that: "Divorce may be requested by one of the spouses when facts constituting a serious or repeated violation of the duties and obligations of marriage are attributable to his or her spouse and make the continuation of life together intolerable."
To prove adultery and thus allow one of the spouses to introduce a contentious application, the fault must therefore meet two requirements imposed by the civil code:
be renewed, in other words, the guilty spouse must be unfaithful on several occasions, regardless of whether the infidelity took place with the same person or several different people.
make the continuation of the common life intolerable. This notion is automatically admitted from the moment the fault is characterized.
Against criminal investigation
A criminal counter-investigation makes it possible to shed light on certain elements neglected or hidden during the investigation of the case.
Examples of investigations
Find witnesses, collect testimonies, analyze clues;
Carry out additional or non-performed investigations
Produce evidence that can be used by your lawyer;
Reopen a file, provide new elements thanks to our research…
The criminal counter-investigation is the only possible means of recourse for the accused individual who believes he has been the victim of a miscarriage of justice and who wishes to prove his innocence. This procedure is most often requested by the accused or his family. It can also be carried out at the request of a civil party. Legally, the criminal counter-investigation cannot be carried out by a lawyer.
The accused must call upon a private detective. His mission will be to reconstruct the facts and conduct new hearings. He will also have to examine all the elements of the file to identify inconsistencies and find new information and the real culprit if there is a miscarriage of justice.
Search for person
The different types of research:
Search for a missing person as part of ongoing or future legal proceedings;
Summons of a third party for legal proceedings;
Service of a court decision for enforcement;
Search for missing persons outside the framework of legal proceedings;
Find a family member with the help of a private detective;
Find a friend or acquaintance with the help of a private detective.
PEI operates both nationally and internationally.
In addition, the agency is able to intervene in the context of recent disappearances or those dating back several years (situations in which you have often exhausted all traditional and official research methods).
Real estate dispute
Real estate disputes constitute a significant portion of the cases handled by the private detective. Indeed, the private detective is often called upon in this case in the context of an illegal sublet, a verification of a rental file, non-payment of rent and neighborhood disturbances.
Enforcing your rights during a real estate dispute can sometimes be complex. The private investigator therefore plays a key role in helping private and professional owners gather the necessary evidence.
The file created by the private detective will allow you to:
Termination of the rental contract in the event of proof of illegal subletting.
Release yourself from all liability in the event of disputes (fire, etc.).
Take legal action against your tenant and claim damages by checking their solvency.
Prevent your tenant from making a profit on a property you own.
Draft a new lease with subtenants to protect yourself legally.
Morality investigation
The morality investigation allows us to deal with different scenarios such as:
An investigation into sectarian excesses.
Investigations into the associates of your child or close family member.
Information for an upcoming wedding.
The interest is to gather relevant information on the behavior of the person who is the subject of the investigation. To do this, the morality investigation is carried out both by OSINT means and in the field.
It is therefore an asset for starting or closing an investigation.
Furthermore, this type of research can meet the need to: find out about the friends of a child whose communication has broken down, the discovery of addictions in a loved one (alcohol, drugs, etc.).
