In terms of labor law applicable to the civil service, Law No. 83-634 of July 13, 1983 on the rights and obligations of civil servants, provides in Article 25 that civil servants and non-permanent agents under public law "may not exercise in a professional capacity a lucrative private activity of any nature whatsoever."
The damage is indeed far from negligible in the presence of agents who are not fully focused and involved in their duties. But if the wrongful conduct of an agent can legally lead to a sanction on the legal level, the burden of proof nevertheless falls on the requesting public administration. The latter must then irrefutably establish the secondary function outside the service of the civil servant.

Unfair work stoppage
Abusive work stoppages result in significant costs for the employer and can cause disorganization, with an increased workload for other employees.
Work stoppage is a right and the employer does not have to oppose it, but he can take certain measures when this stoppage is clearly abusive.
Article L.1132-1 of the Labor Code is clear : illness cannot be used as a basis for dismissal. On the other hand, if the employee's repeated or prolonged absences lead to the disorganization of the company, dismissal is possible.
